Terms of Service
These Terms of Service ("Agreement") govern access to the VesperSpatial catastrophe intelligence platform, Delphi-1.0 actuarial APIs, and associated web consoles provided by VesperSpatial Technologies Inc.
1. Software License & API Usage
Subject to this Agreement and applicable pricing tier terms, VesperSpatial grants users a non-exclusive, non-transferable, revocable license to access our REST APIs, query spatial hazard scores, and execute portfolio accumulation checks.
2. Actuarial Rating & Underwriting Authority Disclaimer
VesperSpatial provides empirical spatial analytics, fuel moisture telemetry, and suggested rate indications powered by the Delphi-1.0 engine. The platform does NOT independently bind insurance coverage. Licensed insurance carriers, Managing General Agents (MGAs), and program administrators retain sole responsibility and final authority for all policy binding decisions, state rate filings, and statutory solvency compliance.
3. Billing, Metering & Payment
Pay-As-You-Go API usage is metered at $0.15 USD per validated quote transaction via Stripe. Monthly subscription tiers ($500/mo MGA Growth) include allocated quote quotas. Invoices are billed automatically to the credit card or ACH account on file.
4. Limitation of Liability
To the maximum extent permitted by law, VesperSpatial shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from natural catastrophe loss events, unforeseen wildfire ignition dynamics, or catastrophic meteorological phenomena exceeding historical statistical bounds.
5. Governing Law
